South of PR-693, beside the Los Paseos de Dorado residential community, a seven-story building is going up. It is planned as a 171-room hotel with 17,500 square feet of commercial space split into 15 storefronts, plus a separate three-story, 56-room senior-care center. It was first promoted as the Hilton Garden Inn At Dorado. It now carries the name Casa Dorado as a Hilton-branded hotel, and its target opening is Thanksgiving week 2027.
DBR Dorado Owner LLC owns the land where Dorado Beach Resort operates. In a notice to residents, DBR said the land-use restrictions covering the site prohibit lodging and any building taller than two stories, as El Nuevo Día reported in August. The building is going up anyway. The court never decided whether those restrictions are valid. It decided that the challenge came too late, and that difference matters to anyone buying near Dorado Beach.
What the Deeds Say, According to DBR
DBR filed suit on July 22, 2026. According to NotiCel's account of the complaint, the claim rests on deeds from 1989 and 1995 that limit the land to residential use and cap buildings at two stories. DBR also claims a recorded easement for wells and pipes across the site. The complaint describes the restrictions as intended to "preserve the resort-type residential character of the protected area."
These restrictions come from private deeds, not from zoning. DBR's position is that the original conditions still govern the later sales of these parcels. Under the deeds' own terms, DBR argued, they could only be lifted with consent from adjacent owners and from owners in the neighboring urbanización. On April 21, 2025, a deed was signed that aimed to release the hotel site from the restrictions. DBR's complaint said that was six months after construction started, and it argued the release could not fix a violation that was already underway.
These were DBR's arguments. The court never ruled on them.
Five Years of Record Before the Lawsuit
Judge Begoña I. De Jesús Meléndez of the Bayamón Court of First Instance decided case BY2026CV03783 on the timeline. Breaking News Puerto Rico's October 1 report lists the facts the ruling relied on:
- 2006 to 2007. The developer acquires the parcels for about $26 million.
- February 24, 2020. A principal linked to DBR receives a written presentation on the hotel and raises no objection.
- August 2020. An entity tied to the same interests asks to intervene in the project's consulta de ubicación, the site-approval review at Puerto Rico's Permits Management Office. It withdraws the request the next month.
- November 2020. The site consultation is approved. Construction permits follow in 2020, 2024 and 2025.
- March 2023. At a Department of Housing meeting about four hotel projects in the federal CDBG-DR program, a DBR-linked principal supports faster financing for all four, this one included.
- December 3, 2024. The Dawn Hotel at Dorado LLC signs an $18,439,000 CDBG-DR agreement that expires December 3, 2026.
- 2025. The court accepts sworn statements that a DBR-linked principal said he would not object if the hotel stayed at five stories. The plan calls for seven.
- July 22, 2026. DBR asks for an injunction, demolition and restoration of the site. It does not ask to limit the claim to the two extra floors.
The building could be seen from PR-693, where offices tied to DBR are located. By the time the case was filed, more than $48 million had been committed and construction was well advanced. The judge concluded that DBR had known the project's details since 2020 and waited more than five years, and that its silence led the developers to keep building. El Nuevo Día reported that the case was dismissed with prejudice.
The Neighbors Lost Their Case on Procedure
Paseos de Dorado Property Owners Association, Inc. represents the 755 unit owners in Paseos de Dorado. It filed the first suit and attacked a different target: the government permits. It lost in the trial court and again on appeal. Both courts found that the association had not taken part in the administrative permitting process it was trying to challenge. DBR tried to join that case to argue the deed restrictions and was not allowed in, which is why it filed its own suit. In late July, NotiCel reported that a Supreme Court review of the association's case had been pending since May.
So two different parties lost with two different arguments. The neighbors argued the permits were wrong, but they had not been part of the permit proceedings. The resort-side landowner argued the deeds forbade the project, and the court found it had waited too long. Neither court considered whether a seven-story hotel belongs on land that DBR says was limited to two-story residential use.

What the Hotel Is Meant to Be
According to El Nuevo Día's September feature, Casa Dorado is an $80 million project backed by 15 cooperatives, aimed at a more accessible price point than the area's luxury resorts. The paper's video coverage says the $80 million does not include land, and that the plan includes an open-air market. A 2024 Primera Hora report said the commercial space could be used for restaurants or tourism businesses. The financing includes $30 million from a group of 15 credit unions led by Zeno Gandía, the CDBG-DR funds, and tax credits from the Puerto Rico Tourism Company.
The timeline has already moved. A November 2024 report projected completion by Christmas 2026. The current target is almost a year later.
How This Changes the Read on Dorado Beach
When you buy at Dorado Beach, you buy into a set of private promises that extends past your own lot line. Your HOA and club structure govern what happens inside the gates. What gets built at the edges can also depend on old recorded restrictions like the ones in this case, and on when and where anyone acts to enforce them.
The Casa Dorado record points to three practical lessons:
- Recorded restrictions do not enforce themselves. A two-story limit in a 1989 deed did not stop a seven-story frame in 2026. The judge's reasoning turned on what the people who could enforce it did between 2020 and 2026.
- The permit record started years earlier. The association lost because it had not taken part in the permitting process. In this project, the site consultation was approved in November 2020, about four years before construction began.
- Releases can be part of the title history. The April 2025 deed shows that a recorded restriction can face a later instrument claiming to lift it. Whether that release was valid is still undecided.
For buyers comparing Dorado Beach parcels, the recorded restrictions belong in due diligence alongside the HOA documents and the CRIM assessment. That includes what the title shows about who can enforce or release them. This post is general information and not legal advice. Have a Puerto Rico real estate attorney review the title documents and any recorded restrictions on a property you're considering.
A Few Quick Questions
Is the hotel inside Dorado Beach? No. It sits beside Los Paseos de Dorado, south of PR-693. DBR's position is that the deeds covering the site carry restrictions connected to the resort lands.
Did the court rule that the deed restrictions are invalid? No. The Bayamón court dismissed DBR's suit because DBR waited too long to file. It did not rule on whether the restrictions or the 2025 release deed are valid.
Is the case over? The trial-court case is closed. DBR can still seek reconsideration or appeal, and the Paseos de Dorado association's separate case was reported as pending before the Supreme Court.
When is it supposed to open? El Nuevo Día reports a target of Thanksgiving week 2027.
